Terms and Conditions for the TRUEWEAR Online Shop

Section 1: Operator of the TRUEWEAR Online Shop and General Terms and Conditions

The TRUEWEAR Online Shop is operated by ILIAS LETSIOS & SIA EE, with its registered office at DISTOMOU 1, 18532, PIRAEUS, GREECE. In these terms and conditions, TRUEWEAR may be referred to as “we” or “our.”

These General Terms and Conditions apply to the purchase of products on our website eu.TRUEWEARORIGINALS.com (referred to as the “Site”).

Section 2: Ordering Process, Contract Closure, and Governing Language

2.1 Ordering Process and Contract Closure for Standard Products
When you select products on our Site and click “Add to cart,” you are making a binding offer to enter into a contract. You can review and modify the items in your shopping bag before completing your order by clicking “Checkout.” If you have a customer account, you can sign in. If not, you can create an account or proceed without one. You need to provide your name, contact details, and select a shipping method. Required information is marked with an asterisk (*). By clicking “Continue to Payment Method,” you proceed to the next step of your order. Here, you can choose your payment method and review your order details. Clicking “Continue to Review & Pay” leads to the final step, where you can review your details and submit your order by clicking “Buy Now.”

2.2 Governing Language
The language you choose during the order process will govern your order, and you can choose between your local language and English.

2.3 Storage of the Contract Text
We will retain the contract text for three years. After completing the order process, you will receive an email containing the contract text. Access to the contract text will not be provided in any other way.

Section 3: End Users, Order Volume, and Technical Errors

TRUEWEAR sells products through its Site to individual end users for personal use, not for trade, business, craft, or profession. Orders may only be placed for normal household quantities, and we may decline or cancel orders exceeding such volumes. Pricing on the Site may be incorrect due to technical or typographical errors, and in such cases, we may cancel the affected orders.

Section 4: Personalized Products

We offer personalized products through our Online Shop, allowing you to customize your preferences. You can add a name and number to jerseys, subject to certain limitations and restrictions. Offensive, infringing, or unlawful content will not be accepted, and we reserve the right to reject or cancel personalized orders that violate these guidelines.

Section 6: Payment

Until full payment is received, merchandise remains our property, except for residents of Hungary, Denmark, Sweden, or Switzerland.

8.1 Legal Cancellation Right

The right to cancel the contract does not apply to contracts for the delivery of goods that are not prefabricated and where the customer’s personal choices or instructions significantly influenced the goods’ production, or when the goods were clearly tailored to the customer’s personal needs.

Your legal warranty rights and remedies apply to the products you purchase without limitations.

Section 10: Liability

TRUEWEAR’s liability is unrestricted in cases of intent and gross negligence. In instances of slight negligence, TRUEWEAR’s liability is limited to foreseeable damages typically associated with contract violations where a cardinal duty was breached. These liability limitations or exclusions do not apply to claims resulting from fraudulent concealment of a defect, guarantees, Consumer Protection Law 2251/1994 (Article 6 regarding Product Liability), and damages related to injuries to life, body, or health.

Any liability exclusion or limitation also extends to the personal liability of TRUEWEAR ‘s employees, representatives, and agents.

Section 11: Privacy Policy

Personal data is handled confidentially in accordance with data protection laws. Please refer to our Privacy Policy for more details on data protection, as it is an integral part of these Terms and Conditions.

Section 12: Governing Law

German law applies, subject to mandatory provisions of your place of residence’s law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Section 13: Codices

TRUEWEAR does not adhere to any code of conduct, except for mandatory codes of conduct stipulated by the laws of your place of residence.

Section 14: Online Dispute Resolution Platform

The European Commission provides an online dispute resolution platform at http://ec.europa.eu/consumers/odr/. TRUEWEAR is not obligated to participate in dispute resolution proceedings before a consumer arbitration board.
